These Terms & Conditions ("Terms") govern your use of the Itemise website and app (the "Service"), provided by Coding Warehouse Limited ("we", "us", "our"), a company registered in England and Wales (company number: 11913265) with its registered office at 1007 London Road, Leigh-On-Sea, Essex, SS9 3JY, United Kingdom. By using the Service, you agree to these Terms.

The Service

Itemise helps you create marketplace listings (such as for Vinted) by analysing photos of your items and generating titles, descriptions and other listing fields. Itemise is an independent product and is not affiliated with, endorsed by or sponsored by Vinted or any other marketplace.

Features, pricing and availability may change, and parts of the Service may be unavailable or change without notice.

Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you meet this requirement and that the information you provide is accurate.

Accounts

You need an account to use the app. You agree to provide accurate information when creating your account, to keep your sign-in credentials secure, and not to share your account with others. You are responsible for activity that happens under your account.

Free sign-up listings are intended for one account per person. You agree not to create multiple accounts, or delete and recreate accounts, to obtain additional free listings. See "Repeat sign-ups and abuse" below.

You can delete your account at any time in the app. When you do, any listings remaining on your account, free or purchased, are forfeited and cannot be refunded or transferred. We retain a minimal record to prevent abuse of free listings, as described in our Privacy Policy.

Your content

You retain ownership of the photos and content you submit ("Your Content"). By submitting Your Content, you grant us a limited licence to process it for the sole purpose of providing the Service to you (including sending it to our AI processing provider to generate listings).

You are responsible for ensuring you have the right to submit Your Content and that it does not infringe anyone else's rights or any law.

AI-generated content

Listings are generated using artificial intelligence and may contain errors, omissions or inaccuracies. You are responsible for reviewing, editing and verifying any generated content before publishing it. We do not guarantee the accuracy, completeness or suitability of generated listings, and you remain responsible for complying with the terms and policies of any marketplace where you post them.

Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent or harmful purpose
• Submit content that is illegal, infringing, or offensive
• Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service
• Misuse the Service in any way that could damage or overload it
• Circumvent usage limits or free sign-up listings, including by creating multiple accounts

Listings, packs & payment

Itemise works on a pay-as-you-go basis. Each AI-generated listing uses one "listing" from your account balance. There is no subscription and nothing recurring.

Free listings. New accounts receive a one-off allowance of free listings (currently 5) when they sign up. This is a single welcome allowance. It does not renew or top up on a monthly or any other basis. Free listings are provided at our discretion; we may change the amount for new sign-ups over time and may withhold, limit or revoke them where we reasonably believe they are being abused.

Listing packs. You can buy additional listings in packs through the Apple App Store or Google Play. Packs are one-time, consumable purchases: you are charged once at the time of purchase, and the listings are added to your account balance. Purchased listings do not expire and remain on your account until you use them. Pack sizes and prices are shown in the app and may change over time; changes will not affect listings you have already bought.

Billing and refunds. Payment is taken by the platform you buy through (Apple or Google), and is subject to that platform's terms. Refund requests for pack purchases should be made to that platform in accordance with its refund policy. Listings are consumed when a listing is generated, and we do not offer refunds, cash-out or exchange for unused listings, including if you delete your account. If a purchase is refunded or reversed by the platform, we may remove the corresponding listings from your account.

Your balance. Listings are tied to your Itemise account, not to your device, and cannot be transferred to another account. If we discontinue the Service, we will give reasonable notice so you can use any remaining listings where practicable.

Repeat sign-ups and abuse

The free sign-up allowance is a one-off welcome gift for each person, not for each account. Deleting your account and signing up again (with the same or a different email address or sign-in provider) to claim the free listings again is a breach of these Terms.

To keep this fair for everyone, we keep a minimal record of deleted accounts (see our Privacy Policy). Where we reasonably believe a new account belongs to someone who has already had their free allowance, we may:

• Provide no free listings on the new account, or remove any that were granted
• Require the account to purchase a listing pack before it can generate listings
• Suspend or close the account, and any other accounts we believe are linked to it

Listings you have actually paid for are not affected by this section: if we close an account under it, we will honour any purchased listings on that account or refund them via the platform you bought through.

Privacy

We collect and use personal data, including product analytics, as described in our Privacy Policy, which forms part of how we provide the Service.

Intellectual property

The Service, including its software, design, branding and content (excluding Your Content), is owned by Coding Warehouse Limited or its licensors and is protected by intellectual property laws. You may not copy, modify or distribute it without our permission.

Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we make no warranties that the Service will be uninterrupted, error-free or fit for any particular purpose.

Limitation of liability

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under law. Subject to that, we are not liable for any indirect or consequential loss, loss of profits, loss of sales, or loss arising from your reliance on AI-generated content. Our total liability to you for any claim is limited to the amount you paid us (if any) in the 12 months before the claim.

Termination

We may suspend or end your access to the Service if you breach these Terms (including by repeatedly creating accounts to claim free listings) or if we discontinue the Service. You may stop using the Service at any time.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continuing to use the Service after changes means you accept the updated Terms.

Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
